In cooperation with two law firms from Italy and China – KPMG LabLaw and Tian Yuan Law Firm, CJO GlOBAL organized the webinar ‘Italy-China Debt Collection’ on 24 Oct 2022.

This is one of the 2022 Webinar Series themed on the landscape of international debt collection in China and other countries.

During the webinar, Ms. Laura Cinicola, Lawyer of KPMG LabLaw (Italy) started with an overview of debt collection in Italy, and then explained two major approaches to collecting debts – the extrajudicial means and the judicial means, while highlighting practical tools, instruments and mechanism under both Italian law and European laws. In particular, she discussed the Italy-China judicial cooperation in civil matters, which enables mutual recognition and enforcement of court judgments between the two jurisdictions.

Mr. Chenyang Zhang, Partner of Tian Yuan Law Firm (China), shared his insights on how to collect debts in China, with general principles and specific methods. He outlined a series of possible approaches, ranging from approaches commonly used in international debt collection, such as amicable debt collection, litigation, arbitration, and mediation, to those less commonly employed but equally feasible and worthy of trying, like recognition and enforcement of foreign court judgments and arbitral awards.

In the Q&A session, two speakers answered the questions from the audience, covering topics like ‘no cure no pay’, product testing and inspection, and impact of the forex control policy.
