Are Amicable Debt Collections Allowed in Turkey? What Are the Main Restrictions?

Yes, amicable debt collections are allowed in Turkey, and it is the most common and preferred way to make debt collection since it is more cost-efficient than going through the legal stage.

There is no such regulation regarding who can collect debts in amicable ways, anyone can get in contact with the debtor and request payment of the debt in amicable ways. But in case the amicable ways do not be efficient and the need to go through the legal stage, the debt collector must be a lawyer since it is mandated by the Attorneyship Code No. 1136.

There is also no regulation regarding how to make an amicable collection, but the debt collector should avoid using harassment-like ways. Otherwise, the debtor may file a complaint against the lawyer to the relevant bar association – to the attorney general if the debt collector is not a lawyer – for the debt collector to be penalized.
