In the dynamic realm of international steel trade, ensuring quality standards is paramount to maintaining trust and integrity in business transactions. Recently, a significant case shed light on the intricate nuances of contractual disputes arising from unqualified steel quality.

Our firm, specializing in international trade risk management, recently handled a complex case involving a steel purchaser and a Chinese steel supplier. The crux of the issue lay in discrepancies in the quality of procured steel plates, leading to a dispute that culminated in legal proceedings.

The scenario unfolded as follows: our client, the steel purchaser, entered into a sales contract with the Chinese steel supplier, stipulating the terms of delivery and payment. Upon delivery, the steel purchaser discovered quality issues in some steel plates during the production process, triggering a series of negotiations that failed to yield a resolution.

Seeking clarity and impartial assessment, we petitioned the court to appoint a specialized testing company to conduct a thorough examination of the steel plates. The subsequent assessment unveiled disparities in tensile and yield strengths, failing to meet national standards, while the chemical composition and impact test adhered to regulations.

Central to the dispute was the applicability of the sales contract, a binding agreement between equal parties delineating rights and obligations. Despite the steel purchaser’s inability to return the majority of the goods due to prior utilization, the court endorsed the return of intact steel plates to the supplier.

In this judgment aimed at equitable resolution, the court ordered the steel supplier to compensate the steel purchaser with a breach penalty of CNY 2.2 million. Additionally, the supplier was directed to retrieve specified steel plates from the purchaser and refund CNY 2.6 million.

This court judgment underscores the significance of stringent quality assurance protocols in international steel trade and emphasizes the legal recourse available to safeguard the interests of stakeholders.
