Can the Creditor Claim From the Debtor for Costs of Debt Collection? (e.g. Fees for Debt Collection Services, Attorney Fees, Litigation Costs) in Germany?

Contributed by Dr. Stephan Ebner, DRES. SCHACHT & Kollegen, Germany.

Yes, it is the debtor who must pay all the costs that are involved with the debt collection, no matter whether it is an amicable debt collection or a state-run debt collection through a bailiff.

The term “all costs” mean attorney fees and fees related to translation, notarization, certification, and so on.
